Terms of Service

1. Acceptance of Terms

By accessing and using Elysium Group ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access the Platform. The Platform is operated under the laws of the Kingdom of Thailand.

2. Platform Description

Elysium Group is a luxury real estate marketplace that connects property buyers, renters, and investors with verified real estate agents and property listings across Thailand. We act as a platform facilitator and do not directly sell, rent, or manage properties.

3. User Accounts

  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the security of your account credentials
  • You may not use another person's account without authorisation
  • Agent accounts require valid business documentation and are subject to verification
  • We reserve the right to suspend or terminate accounts that violate these terms

4. Property Listings

Agents and property owners who list on the Platform agree to:

  • Provide accurate, truthful, and current property information
  • Hold valid legal rights to list the property
  • Comply with all Thai real estate regulations and disclosure requirements
  • Update or remove listings promptly when properties are sold, rented, or no longer available
  • Not post misleading photos, descriptions, or pricing

Elysium Group reserves the right to remove any listing that violates these terms or our quality standards.

5. Subscription & Payment Terms

Agent subscriptions are billed monthly or annually as selected. All prices are in Thai Baht (ΰΈΏ) unless otherwise stated. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis. Featured listing fees and premium placement fees are non-refundable once the placement has been published.

6. Commission & Referral Fees

For transactions facilitated through the Platform, Elysium Estates may charge a referral fee or commission percentage as agreed in the agent's subscription terms. Commission rates are configurable and transparent β€” agents can view their rates in their dashboard at all times.

7. Intellectual Property

All content on the Platform β€” including design, text, graphics, logos, and software β€” is owned by Elysium Group or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

8. Limitation of Liability

Elysium Group provides the Platform on an "as is" basis. We do not guarantee the accuracy of property listings, agent credentials (beyond our verification process), or transaction outcomes. We are not liable for losses arising from property transactions between users. We strongly recommend independent legal and financial advice before any property transaction in Thailand.

9. Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes shall be resolved in the courts of Surat Thani Province, Thailand, unless otherwise agreed.
